These terms govern your use of smartcat.globalswanky.com and any purchase you make from Global Swanky LLC. Please read them before ordering.

Agreement

By accessing smartcat.globalswanky.com or placing an order, you agree to these Terms of Service together with our Privacy Policy, Shipping Policy, Refund & Return Policy and Limited Warranty, all of which form part of this agreement. If you do not agree, please do not use the site.

Eligibility

You must be at least 18 years old and able to form a binding contract to place an order. By ordering you confirm that you meet those conditions and that the information you provide is accurate and complete.

Orders and acceptance

An order placed through the site is an offer to buy. A contract forms only when we dispatch the goods and send you a dispatch confirmation. An order confirmation email acknowledges receipt; it is not acceptance.

We may decline or cancel an order, in whole or in part, where:

  • The item is out of stock or has been discontinued.
  • A pricing or description error has occurred — see Pricing.
  • We suspect fraud or an unauthorised transaction.
  • The order breaches these terms, or quantity limits set for a promotion.
  • We cannot ship to the address given.

Where we cancel an order you have already paid for, we refund it in full.

Pricing and payment

Prices are shown in United States dollars and exclude sales tax, which is calculated and shown at checkout based on your shipping address. The current price of the SmartCat S12 is $149.00.

Any "compare at" or strikethrough price shown alongside it represents a former price at which the product has been offered, or the manufacturer's suggested retail price. It is not a representation that the item has been sold at that price in every market or period.

We try hard to keep prices and descriptions accurate. If an item is listed at a materially incorrect price because of a technical or typographical error, we will contact you before dispatch and give you the choice of confirming at the correct price or cancelling for a full refund. We will not simply charge you the higher amount.

Payment is processed by Shopify. You confirm that you are authorised to use the payment method presented.

Shipping and risk

Delivery estimates are estimates, not guarantees. Title and risk of loss pass to you on delivery to the address you provided. Full terms are in the Shipping Policy.

Returns and warranty

Returns are governed by the Refund & Return Policy, and hardware faults by the Limited Warranty. Those documents set out the conditions, timeframes and any deductions that may apply.

Acceptable use

You agree not to:

  • Use the site for any unlawful purpose, or in breach of any applicable regulation.
  • Attempt to gain unauthorised access to the site, its servers or any connected system.
  • Introduce malware, or interfere with the operation of the site — including by automated scraping that places unreasonable load on it.
  • Reproduce, resell or exploit any part of the site without our written permission.
  • Submit false, misleading or fraudulent information, including in a review.

Safe use of the product

The SmartCat S12 is a mains-powered appliance intended for indoor domestic use with cats aged six months or older and weighing at least 3 lb (1.36 kg). You agree to follow the instructions supplied with it, including:

  • Placing it on a flat, stable, indoor surface away from direct sunlight and open flame.
  • Using only clumping mineral or bentonite clay litter.
  • Keeping the sensors clean and unobstructed.
  • Not washing the motor housing or control electronics.
  • Supervising kittens, unwell cats and cats below the minimum weight.

The safety systems are aids, not substitutes for supervision. No automated litter box should be treated as risk-free for an animal. If your cat is very young, elderly, unwell, has impaired mobility or behaves unpredictably around the unit, use manual mode or a conventional litter box.

Intellectual property

All content on this site — text, layout, graphics, photography, logos and code — is owned by or licensed to Global Swanky LLC and is protected by intellectual property law. See our Intellectual Property Rights page for detail, including how to report an infringement.

Reviews and submissions

If you submit a review, photograph, video or other content, you grant Global Swanky LLC a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with the product and our marketing. You confirm that the content is your own, is truthful, and reflects your genuine experience.

We do not pay for reviews, and we do not condition any incentive on a review being positive. We may remove content that is unlawful, abusive, off-topic or demonstrably fake, but we do not remove a review simply because it is critical.

Third-party links

The site may link to third-party sites, including our checkout on Shopify. We are not responsible for their content, practices or policies, and a link is not an endorsement. Review their terms and privacy policies before using them.

Disclaimers

Except as expressly stated in these terms or in the Limited Warranty, and to the fullest extent permitted by law, the site and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the site will be uninterrupted or error-free, or that defects will be corrected. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Global Swanky LLC and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or in connection with your use of the site or the product.

Our total aggregate liability arising out of or relating to these terms or any product will not exceed the amount you paid for the product giving rise to the claim.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

Indemnity

You agree to indemnify and hold harmless Global Swanky LLC from any claim, loss or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the site, or your violation of any law or third-party right.

Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. The courts located in Natrona County, Wyoming will have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction, and except where mandatory consumer protection law in your state of residence gives you the right to bring proceedings there.

If any provision of these terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions stay in full force.

Changes

We may amend these terms from time to time. The version in force at the moment you place an order is the version that governs that order. Continued use of the site after changes are posted constitutes acceptance of the amended terms.
